Sustainability PR: How to Avoid Greenwashing Claims

Sustainability PR: 6 Rules to Avoid Greenwashing in 2026
Share:

Sustainability public relations (PR) is the practice of communicating a company's environmental performance so every claim can be checked, and it now carries legal weight. European Union (EU) rules limiting generic claims such as "eco-friendly" applied from September 27, 2026. The Federal Trade Commission (FTC) Green Guides warn against unqualified general environmental benefit claims, and the Securities and Exchange Commission (SEC) fined DWS $19 million in 2023 over environmental, social, and governance (ESG) statements it did not follow.

What is sustainability PR?

Sustainability PR, also called environmental PR, is the work of explaining what a company does about its environmental and social impact to customers, investors, employees, regulators, and journalists. It sits inside corporate communications and covers product claims, sustainability reports, executive commentary, and responses to criticism.

The discipline has three parts that are easy to confuse, and each carries a different risk.

PartPurposeMain risk
Sustainability PRExplains performance and progress to every audienceClaims that outrun the evidence
ESG and sustainability reportingDiscloses measured data to investors and regulatorsInaccurate or unverified figures
Product and brand claimsSells a product on an environmental benefitGeneric or misleading labels

The 5W sustainability PR agency practice runs programs across all three. This guide explains the rules that shape them.

Why is greenwashing risk higher in 2026?

Greenwashing risk is higher in 2026 because regulators in the EU and the U.S. have written down what counts as a misleading environmental claim, and enforcement has followed. Three rules matter most for communications teams.

RuleWhat it saysWhat it means for PR copy
EU Directive 2024/825 (Empowering Consumers for the Green Transition)Applies from September 27, 2026. Generic claims such as "green" or "eco-friendly" are not allowed unless they rest on recognised excellent environmental performance or state the specific benefit in the same communication, according to Baker McKenzieName the specific benefit next to the claim, and review stock and packaging that stays on sale after the date
FTC Green Guides (16 CFR Part 260)The FTC's revised Guides say marketers should not make unqualified general environmental benefit claims, because it is highly unlikely they can substantiate every reasonable interpretationQualify broad claims with clear, prominent language that limits them to a specific benefit
SEC action against DWSIn September 2023, DWS agreed to pay a $19 million penalty over misstatements about its ESG investment process, per Kramer Levin's summary of the orderDescribe only the processes the company actually follows

The EU directive applies primarily to business-to-consumer communications, according to Bird & Bird, but a U.S. brand that sells to EU consumers is covered. Brand names, images, and colors can also imply an environmental claim under the European Commission's guidance, so a leaf logo needs the same evidence as a sentence.

What makes an environmental claim defensible?

An environmental claim is defensible when it is specific, limited to what the evidence covers, tied to a method, and checked by someone outside the marketing team. A claim card answers five questions before any copy is approved.

ElementQuestion to answerWeak claimStronger claim
ScopeDoes the claim cover the whole product or one aspect?"A sustainable bottle""A bottle made with recycled glass, with the recycled share stated on the label"
Baseline and periodCompared with what, and over what time?"We cut our emissions""We reduced emissions from our own facilities against the baseline year in our report"
MethodWhich standard produced the number?"Low carbon""Calculated under the Greenhouse Gas (GHG) Protocol"
VerificationWho outside the company checked it?"Independently proven""Reviewed by a named third-party assurer"
LimitsWhat does the claim leave out?No mention of exclusions"Covers owned operations; supplier emissions are reported separately"

Keep the evidence behind each card in one file: the data source, the calculation, the verification status, the reporting period, and the version. When a journalist or regulator asks, the team answers from the file in minutes.

Which words should a sustainability message avoid or qualify?

A sustainability message should avoid absolute and generic words and qualify any claim that depends on offsets or future promises. These phrases draw the most scrutiny.

Phrase or practiceWhy it is riskySafer approach
"Eco-friendly," "green," "sustainable"Generic terms that EU rules restrict and the FTC advises against without qualificationState the specific benefit in the same sentence
"Carbon neutral" resting only on offsetsLegal commentary on the EU rules treats claims based solely on compensation as high risk, per DWFReport emissions cuts and offsets as separate facts
"Zero impact," "100% green"Absolute claims are hard to proveDrop the absolute and describe the measured result
Green imagery and brand namesImages and names can imply a claimMatch visuals to documented benefits
Net-zero targets with no planA distant goal without steps reads as aspirationPublish interim targets and the actions behind them

What do packaging rules mean for consumer brands?

Packaging rules in the EU and California now attach dates to recyclability, so a consumer packaged goods (CPG) brand's on-pack claims must match what the pack can actually do. Two rule sets set the pace.

RuleWhat it requiresKey dates
EU Packaging and Packaging Waste Regulation (Regulation (EU) 2025/40)Recyclable packaging, minimized weight and volume, standardized recyclability labels, and limits on PFAS in food-contact packagingApplies August 12, 2026; labels from August 2028; recyclability and minimization from January 1, 2030, per PwC Malta's summary
California SB 54Single-use packaging recyclable or compostable, a 25% cut in single-use plastic packaging, and a 65% recycling rate for single-use plastic packaging2032 targets, per CalRecycle's report to the Legislature

Shoppers care about recyclability but weigh price and quality more. McKinsey's March 2025 survey of U.S. consumers found 77 percent call recyclability extremely or very important, while 44 percent say the same of environmental impact overall, according to McKinsey's 2025 U.S. packaging survey.

For the claim itself, name the material, the share of recycled content, and where the pack can be recycled, and substantiate it before the pack ships. List every packaging component by material and supplier, flag the ones that block recyclability under these rules, and replace those first. A green packaging claim that works in one market can confuse another, since consumers in different countries disagree on which materials are most sustainable.

How should sustainability PR differ by industry?

Sustainability PR differs by industry because each sector makes different claims and faces different proof. A fashion brand is judged on materials and production, a spirits brand on water, packaging, and sourcing, a travel brand on community benefit, and an investment firm on whether it follows the process it advertises.

IndustryTypical claimWhat to show
FashionEco-friendly materials and responsible productionNamed materials, production steps, and third-party audits, supported by honest visuals of the supply chain
Spirits, wine, and beerLower water use, recycled packaging, local sourcingPublished impact reports and specific packaging and sourcing facts. See sustainability claims in alcohol marketing
Travel and hospitalityBenefit to local communities and the environmentCertifications, named local partners, and specific actions on waste, energy, and sourcing
Consumer packaged goodsRecyclable, reusable, or compostable packagingThe material, recycled content, and where the pack can be recycled
Financial servicesESG integration in investment decisionsWritten processes that the investment team demonstrably follows

The common thread is stories built on facts. Customers connect with the people behind a brand and the effect of its choices, and 5W's guide to sustainable brand practices covers how to tell them.

Who needs which sustainability message?

Four audiences need different versions of the same facts: investors, customers, employees, and regulators. The evidence stays constant, and the emphasis and channel change.

AudienceWhat they wantBest channel
InvestorsClimate risk, governance, and progress against targetsAnnual and sustainability reports, investor calls
CustomersProduct claims they can checkProduct pages, packaging, and social media
EmployeesEvidence that the company acts on its valuesInternal updates and town halls
RegulatorsAccuracy and completenessRequired filings and direct submissions

How do you review sustainability claims before they publish?

A team reviews sustainability claims by treating each one as a draft until it clears a fixed sequence of checks. The sequence below works for a press release, a product page, or a report.

  1. List every environmental claim in the draft, including those in images and headlines.
  2. Match each claim to a claim card and its evidence file.
  3. Have the sustainability or operations lead confirm the data, and legal review the wording.
  4. Check that any third-party verification is named and current.
  5. Record the approved wording and the date, and set a date to review it again.

Refresh claims on a schedule. A figure that was accurate when published can become misleading as operations change.

What should you do when someone accuses you of greenwashing?

When someone accuses a company of greenwashing, it should check the claim against its evidence file within hours, then correct or withdraw anything it cannot support and publish the specifics of what it can. Silence or a defensive reply often does more damage than the original claim.

Brief spokespeople with the facts, avoid quietly deleting content that has already been quoted, and say what has changed. The crisis PR guide sets out the response sequence, and artificial intelligence (AI) crisis monitoring can give early warning when criticism starts to spread.

How do you measure sustainability PR?

Sustainability PR is measured by the quality of coverage, the number of claims challenged, stakeholder trust, and how accurately search and AI tools describe the company's record. Count coverage that repeats the specific facts, not only coverage that mentions the brand.

Track every challenge to a claim, whether from a journalist, a customer, or a regulator, and the time taken to answer it. Check what AI assistants say about the company's environmental record, and correct outdated or false descriptions at the source. See measuring PR effectiveness for how to set baselines.

Sustainability PR FAQ

What is the difference between sustainability PR and environmental PR?

The terms overlap. Environmental PR focuses on a company's impact on the natural world, while sustainability PR also covers social and governance topics.

Is "sustainable" a banned word in the EU?

Not outright. Under Directive 2024/825, generic terms such as "sustainable" are allowed only when the company can show recognised excellent environmental performance or states the specific benefit in the same communication.

When does the EU packaging regulation apply?

The EU Packaging and Packaging Waste Regulation applies from August 12, 2026, with recyclability and minimization requirements following from January 1, 2030, according to PwC Malta's summary.

Do the FTC Green Guides have the force of law?

The Guides are guidance, not statute, but they describe the claims the FTC considers deceptive under the FTC Act, so marketers treat them as the working standard.

What is the first step to avoid greenwashing?

List every environmental claim the company makes today and match each one to documented evidence, then fix or remove the ones without it.

What should a company do first?

A company should audit its current environmental claims, build a claim card and evidence file for each, rewrite generic wording to name the specific benefit, and set a review date. The 5W sustainability PR agency practice builds and reviews these programs, and the guide to what public relations is covers the fundamentals.
